海口市人民代表大会常务委员会关于修改《海口市出租汽车客运管理条例》的决定
(2011年9月1日海口市第十四届人民代表大会常务委员会第三十八次会议通过 2011年9月28日海南省第四届人民代表大会常务委员会第二十五次会议批准 2011年10月8日海口市人民代表大会常务委员会公告第24号公布 自公布之日起施行)
海口市第十四届人民代表大会常务委员会第三十八次会议决定对《海口市出租汽车客运管理条例》作如下修改:
一、将第五条第二款和第四十七条第一款中的“人事劳动保障”修改为“人力资源社会保障”。
二、第九条第二款修改为:“从事出租汽车营运,应当依照国家有关规定和本条例规定,经行政许可取得出租汽车经营资格证、车辆运营证和驾驶员客运资格证。
“禁止无出租汽车经营资格证、车辆运营证和驾驶员客运资格证从事出租汽车客运活动。”
三、第二十条第一款修改为:“经营者应当依法与所招聘的驾驶员签订劳动合同,并依法为驾驶员缴纳养老、医疗、工伤、失业、生育等社会保险费。”
四、增加一条作为第二十一条:“出租汽车驾驶员应当持有以本人实名登记的客运资格证及服务质量监督卡,驾驶经营者核准的车辆上岗营运。
“驾驶员身份证、客运资格证及服务质量监督卡应与准驾车辆一一对应,并报市公交客运管理机构备案。”
五、将第二十三条和第二十四条合并为第二十四条,修改为:“经营者或者驾驶员不得转让、出租、出借出租汽车经营资格证、车辆运营证或者驾驶员客运资格证,不得将出租汽车交给无出租汽车驾驶员客运资格证的人员从事客运经营活动。”
六、第二十七条增加一款作为该条第二款:“驾驶员在营运过程中应当自觉接受市交通部门和市公交客运管理机构对其服务质量的监督检查,防止出现服务质量事件。”
七、第三十一条修改为:“市公安机关交通管理部门应当根据道路安全、畅通和方便乘客的原则,会同市交通部门在城市有条件的道路上合理划定出租汽车临时停靠点。市公安机关交通管理部门和市交通部门按照各自职责对临时停靠点进行管理。”
八、第三十三条修改为:“市交通部门在监督检查过程中,对违反本条例第二十三条、第二十四条、第二十七条、第二十八条规定的经营车辆,可以暂扣其车辆运营证;没有车辆运营证又无法当场提供其他有效证明的,可以暂扣其经营车辆,并依法作出处理决定。
“市交通部门暂扣车辆应当出具暂扣凭证并妥善保管,不得收取或者变相收取保管费用,不得使用暂扣车辆。市交通部门依法进行处理后,应当及时通知当事人领回有关车辆或证件。
“暂扣的违法车辆,达到国家规定的强制报废标准的,由市交通部门移交公安机关依法进行报废处理;逾期未接受处理且未达到国家强制报废标准的,由相关部门依法处置。”
九、第四十条第一款修改为:“违反本条例第九条规定,无出租汽车经营资格证、车辆运营证从事出租汽车客运经营活动的,由市公交客运管理机构责令停止经营,没收违法所得,按每辆车处5000元以上3万元以下的罚款。”
十、第四十一条第(二)项修改为:“(二)违反本条例第二十四条规定,转让、出租、出借出租汽车经营资格证或车辆运营证的。”
十一、第四十二条修改为:“违反本条例第二十三条第二款规定,非本市出租汽车从事起点和终点均在本市行政区域内的客运活动的,由市公交客运管理机构责令停止经营,按每辆车处1000元以上5000元以下的罚款;载客进入本市行政区域,乘客下车后显示空车待租标志或者重新载客的,由市公交客运管理机构责令改正,处400元以上2000元以下的罚款。”
十二、第四十三条修改为:“经营者或驾驶员违反本条例第二十四条规定, 出租、出借驾驶员客运资格证,或者将出租汽车交给无驾驶员客运资格证的人员从事客运经营活动的,由市公交客运管理机构责令改正,处400元以上2000元以下罚款;情节严重的,由市交通部门吊销有关证件。”
十三、第四十五条修改为:“驾驶员违反本条例第二十一条规定,或者违反本条例第二十七条第一款第(一)、(三)、(六)、(七)、(九)项规定的,由市公交客运管理机构处400元以上2000元以下罚款;情节严重的,由市交通部门吊销其客运资格证。违反本条例第二十七条第一款其他规定,或者违反本条例第三十二条规定不配合监督检查的, 由市公交客运管理机构处100元以上500元以下的罚款。
“驾驶员在营运过程中出现服务质量事件的,由市公交客运管理机构暂扣客运资格证,重新培训考核直至合格。”
十四、增加一条作为第四十九条:“本条例所称服务质量事件,是指出租汽车驾驶员在营运过程中,违反有关出租汽车服务国家标准中关于服务的规定,拒绝为特殊人群提供特殊服务,或者在机场、火车站等大型客流聚散地拒载、甩客、宰客、私揽他人同乘以及绕道多收费等行为,被曝光或者被投诉并经核实,社会影响较差的服务事件。”
十五、将第二十一条、第二十二条分别改为第二十二条、第二十三条。将第四十九条改为第五十条。
本决定自公布之日起施行。
《海口市出租汽车客运管理条例》根据本决定作相应修正,重新公布。

There is hereby established a body to be known as the Securities
and

The Commission shall be a body corporate with power to sue
